in 1978 he got me fired from the O.R saying to human resources that i was looking to close to his work and not doing my job , i returned to the O.R in 1988, when he was Tossed out of the Hospital

SENTENCING HEARING

Counsel for the College presented no direct evidence. Counsel for Dr. R. filed a document book & called 6 witnesses in support of Dr. The evidence presented revealed the following history.

Chronology of Significant Events

5 Dec 10, 1990 - The incident with patient FIJ at Hospital XPL & resultant complaint to the police.

Jan 1991 - Dr. R. consulted a psychiatrist, Dr. ORC, regarding marital problems.
Oct 1991 - Dr. R. consulted a psychologist, Dr. ACK.
Nov 1, 1991 - Criminal charges were filed & Dr. R. resigned his licence to practise in Quebec.
Nov 4, 1991 - Dr. R. pleaded guilty in Quebec court & was later sentenced.
Dec 1991 - The Board of the Directors of Hospital RCF held a hearing regarding other complaints that had been made against Dr. R. As a result of this hearing, Dr. R's privileges at Hospital RCF were revoked. There were sworn declarations from 5 complainants which were uncontested. The complaints were as follows:
(i) In 1989, a nurse went to the office of Dr. R.to discuss various matters involving her department. During the discussion concerning various administrative matters, Dr. R. left his chair, sat beside the nurse & embraced & hugged her. She was embarrassed by his actions & pushed him away;

(ii) Another nurse complained of events that took place in 1987. She reported that she was standing in line at the photocopy machine when Dr. R. approached her from behind. He stood close enough that she could feel his warm breath on her neck. He then also briefly kissed her on the neck. The same nurse was involved in another incident which took place at another time. She was in a room 6 with the mother of a patient. Apparently Dr. R. came into the room & stroked her breast. The nurse was quite upset & pushed him away. It is reported that she developed a phobia concerning Dr. R. & had to be treated with psychotherapy;

(iii) In 1985 a young patient was hospitalized with a severe illness. The mother regularly visited the child. She reported that Dr. R. complimented her on her physical appearance & also invited her for dinner. He offered to drive her home or elsewhere, however, she declined these invitations. Dr. R. told her that he would like to see her in a bikini. On one occasion, she came to his office & he locked the door. She became worried and asked him to unlock it. He did this immediately & left the office without any discussion concerning the treatment of her child. The mother had a habit of sleeping in the hospital in the same room as her child. She complained that Dr. R, who arrived extremely early in the hospital at around 6:00 a.m., came into the room & watched her sleeping & looked while she was getting up & getting dressed. This caused her distress & she consequently, tried to avoid Dr. R. within the hospital setting;

(iv) A technician complained of events that took place in 1989 when Dr. R. hugged her and embraced her;

(v) A 17-year-old patient was invited to the hospital by Dr. R. He explained to the patient that he would like to show her a private room. He took her into the room and closed the door. Dr. R, fondled her breasts and held her in his arms. At that time he had an erection and was attempting to kiss her. When his pager went off he left the room and the patient was able to leave.

- January 1992 - A civil suit regarding the matter of FIJ was settled for $20,000.00.

- June 1992 - Dr. R. consulted Dr. DYI, a psychiatrist.

7- August 26, 1992 - There was a hearing before the Corporation Professionelle des Medicins du Quebec. The 'Corporation' charged Dr. R. with having committed derogatory acts: 1) by failing to maintain, in the exercise of his profession, irreproachable conduct toward one of his female patients, 15 years of age, on the occasion of a medical consultation at the outpatient clinic Hospital XPL, on or about Dec 10, 1990; in speaking inappropriately, and touching in a sexual nature, thus violating the effective regulations of the Corporation Professionelle des Medicins du Quebec, and in particular Section 2.03.08 of the Code of Ethics : 2) by failing to maintain, in the exercise of his profession irreproachable conduct toward one of his female patients, 17 years of age, on the occasion of a medical consultation at the outpatient clinic of Hospital RCF, on or about Aug 16, 1984; in speaking inappropriately, and touching in a sexual nature, thus violating the effective regulations of the Corporation Professionelle des Medicins du Quebec, and, in particular, Section 2.03.08 of the Code of Ethics.

Dr. R, pleaded guilty to the first count. He was found guilty of the second count.

The penalty imposed upon Dr. R. by the corporation Professionelle des Medicins du Quebec was a reprimand and a suspension of licence for 6 months, served from Dec 1, '92 - May 31, '93. June 1993 - Dr. R. resumed office practice in Quebec. All hospital privileges had been rescinded.
Sept '93 - Dr. R. consulted a psychiatrist.

THE COLLEGE OF PHYSICIANS AND SURGEONS OF ONTARIO & DR. MICHAEL A. ROSMAN
HEARING: JUNE 27 - 29, 1994 DECISION: SEPT 6, 1994 DECISION AND REASONS FOR DECISION
This matter was heard by the Discipline Committee at the College of Physicians and Surgeons of Ontario on June 27-29, 1994 at Toronto.
ALLEGATIONS:
1) That Dr. R. on Dec12, '91 in the Court of Quebec ...was convicted of an offense relevant to his suitability to practice, to wit that on Sept10, '90..., he sexually assaulted a minor patient, a criminal act.
2) That Dr. R. on Dec12, '91, in the Court of Quebec...was convicted of an offense relevant to his suitability to practise, to wit that on December 10 '90...he committed sexual exploitation by touching an adolescent’s body part thereby committing the criminal act.
(3) That Dr. R., on December 10, '90, did conduct himself in a fashion that constituted conduct relevant to the practice of medicine, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional, to wit that he sexually assaulted a minor female patient, which is professional misconduct.
548, made under Part III (Medicine) of the Health Disciplines Act, 1990 & Section 61(3)(c) of the said act.
(4) That Dr.R, or Dec 10, ‘90, did conduct himself in a fashion that constituted conduct relevant to the practice of medicine, that having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional, to wit that he committed sexual exploitation by touching an adolescent's body part thereby committing a criminal, which is professional misconduct under paragraph 33 of Section 29 as amended, of Regulation 548, made under Part III (Medicine) of the Health Disciplines Act , 1990 and Section61(3)(c) of the said Act.
Dr. R. pleaded guilty to allegation #2. Allegations 1,3 and 4 were withdrawn by Counsel for the College.
SUMMARY OF AGREED FACTS
The facts presented to the Committee in support of Dr. R.'s plea of guilty:
Dr. R. is a paediatric-orthopaedic surgeon who had practised in the same city for 20
years. He was licensed in the provinces of Quebec, Ontario and Newfoundland.
On December 10, 1990 he examined patient FIJ, a 15 year-old female, at Hospital XPL.
4 Following this examination, the patient complained almost immediately to the police, alleging sexual misconduct.
On November 1, 1991, Dr. R. was charged with sexual assault and with sexual exploitation regarding this incident. He pleaded guilty to one count of sexual exploitation, and on Dec 12, 1991 was sentenced to 8 months in jail and 1 year probation.
Dr. R. served forty days of the sentence of imprisonment prior to his release on parole.
Details of the offence included the fact that the victim had been a patient of Dr. R.'s
for 10 years, but that this was the first time she had visited him without her parents being present. The misconduct included: rubbing his pelvis against that of the victim while having an erection; touching the victim's breast and nipples; asking the victim for a kiss; putting the victim's arms around his neck and asking for a hug; and making inappropriate comments such as, "you're cute".
The victim was very upset and missed one year of school as a result of this incident.
The Committee accepted Dr. R.'s guilty plea and found him guilty of an offence relevant to his suitability to practise, to wit that on December 10, 1990..., he committed sexual exploitation by touching an adolescent's body part thereby committing the criminal act set forth in article 153(1)(a) of the Criminal Code, which is professional misconduct under Section 61(3)(a) of Part III (Medicine) of the Health Disciplines Act, 1990.

working with this dr, I had to be careful with what I say, since it was my daughter being treated him, he gave a diagnosis without an x-ray, then after taking an x-ray proved him worng , ok he is not god but unlike in the usa all dr pass a xray or mri !

working with Dr. Rosman in the ER. back in the 70's was great he was kind , but when i worked with him in the O.R 1979he made a accusiaon that i was looking at him to close , & he toss me out of the operating Room, i return to the OR in 1988 ,, only to find out by the staff bathroom walls that he is a Pedafile, now that made sense to why he wanted me out of the operating room back in 1978, i seen him 8 years ago at the viau medical clinic, Dont get me wrong , he is one of the best orthopedic Doctors in quebec, yes he is Horrible , he was kick out of 3 hospitals in canada , all childrens hospitals :( :(

Sorry Ladies, this Story about Dr. Mike came from a wee Lassie that was just Operated for Hip Dyspepsia. I was in the Room and Familiar with what Happened and where these accusation grew. Sorry Dr. Mike. I remember working with you and Dr. Al.

I'm so thankful that I met dr. Rossman 32 years ago when he changed my life forever. I was told I would never walk or talk and there were only six known cases of my infinite polymosites and arthroposis. I wish there was some way I could contact him and thank him personally for everything he's done for me. If your reading this Dr Rosman u may remember me and you were also close with my dad. My dad always thought you were such a great man and told me so much about you. Forget what all these people say your a good person and my dad felt the same. He recently just passed away of cancer :( I wish u all the best! Tina
