RateMDs Inc. Paid Plan Terms of Use

This Paid Plan Terms of Use is a legally binding agreement between you ("you") and RateMDs Inc., a California company ("RateMDs"). Your use of the website located at https://www.ratemds.com/ (the "Website") and access to your Paid Plan is subject to legally binding terms and conditions set forth herein and your compliance with RateMDs’ Terms of Use located at https://www.ratemds.com/about/terms/paid/, both of which are hereby agreed to by you on the date hereof (the "Effective Date") by subscribing to a Paid Plan.

  1. Paid Plan. During the Term, RateMDs will provide you with services relating to the Paid Plan selected by you on the Website. You acknowledge that RateMDs reserves the right to change Paid Plan features from time to time in its sole discretion and no refunds will be provided. In accordance with this Paid Plan Terms of Use, you may upgrade or downgrade your Paid Plan at any time. You will not be provided with any refunds or pro-rations related to any price reduction for the remainder of the month in which you downgrade your Paid Plan. You will be responsible for paying the price increase on any upgraded Paid Plan on the date such Paid Plan is upgraded. Other than the features specific to your Paid Plan, you acknowledge that the Paid Plan provides no preferential treatment on the Website.
  2. Term. This Paid Plan Terms of Use has a one (1) month term commencing on the Effective Date and will automatically renew on a monthly basis, unless terminated by you in advance via the billing section under your account settings on the Website.
  3. Payment. Payment shall be made in full in advance of each month via credit card as set out on the Website. Your credit card will be automatically charged at the beginning of each billing cycle unless you terminate your Paid Plan in advance in accordance with Section 2 and 4. Any such payment is wholly non-refundable.
  4. Compliance. It is your sole responsibility to ensure that the Paid Plan and your use thereof do not violate any rules, standards, guidelines, laws, regulations or policies that govern your profession (“Rules”). Without limiting the generality of the foregoing, by uploading photos to your gallery, you represent and warrant to RateMDs that you have obtained the required consents from patients (and others that may appear in the photos) and that the photos otherwise comply with applicable Rules as to their use, presentation, content and manner in which they were taken.
  5. Termination. You may terminate your Paid Plan at any time via billing section under your account settings on the Website but no refund will be provided for the remainder of the month in which you terminate your Paid Plan. You understand that RateMDs reserves the right to terminate your Paid Plan or downgrade your Paid Plan at any time without notice to you in its sole discretion.

  7. Governing Law. This Paid Plan Terms of Use is governed by the laws of the State of California and the applicable federal laws therein.
  8. General Disclaimer and Limitation of Liability. Your Paid Plan and the related services are provided on an "as is" basis and any use or reliance thereon is at your sole risk. RateMDs makes no express or implied representation, warranty or guarantee of any kind regarding the Website, any Paid Plan, the Website visitors, the Website content or any doctor reviews on the Website, whatsoever (including, without limiting the generality of the foregoing, whether the Paid Plan and the related services comply with applicable Rules). RateMDs is not responsible or liable for any loss or damages whatsoever, including, without limitation, any direct, indirect, incidental, special or consequential damages or other damages (including damages for harm to business, loss of information, data or content, loss of profit, loss of savings, loss of revenues), arising from or in connection with the use of or access to, or the inability to use or access, the Website, any content or reviews posted on the Website, or any other matter.
  9. RateMDs may revise these Paid Plan Terms of Use from time to time. The changes will be effective as of the date of posting, and the most current version of the Paid Plan Terms of Use, which will be posted at https://www.ratemds.com/about/terms/paid/, will govern RateMDs relationship with you. By continuing to access or use the Paid Plan services after changes become effective, you agree to be bound by the revised Paid Plan Terms of Use. If you do not agree, your only recourse is to terminate this agreement and cancel your Paid Plan.
  10. Acceptance. By clicking "I Agree" below, you hereby confirm that you have read and fully understand these Paid Plan Terms of Use and that you agree to be bound by these and other Terms incorporated by reference above.
